What is selective enforcement?

Selective enforcement happens when an HOA enforces a rule against one homeowner while ignoring the same violation by others. Because associations are generally expected to enforce their rules evenly, uneven enforcement can undermine a violation.

Why it works

Governing documents and general fairness principles expect consistent enforcement. If the board cites you for tall grass but lets three neighbors' lawns slide, it's hard to justify singling you out.

How to document it

Walk your street and photograph comparable properties with the same condition. Capture a visible date and, where possible, an address or landmark. Only photograph from public areas — never trespass.

Then request the association's enforcement history for the last couple of years for the same type of violation. A records request often reveals inconsistent enforcement.

How to use it
