HOA selective enforcement letter template
Selective enforcement is strongest when you can show a pattern: the HOA is enforcing a rule against you while ignoring comparable violations nearby. The letter should focus on evidence, not accusations.
Document comparable properties
Photograph similar conditions from public areas and record the date. The best comparisons are close in time, close in location, and involve the same rule.
Do not trespass or photograph private areas. You only need enough evidence to show the board that enforcement may be uneven.
Ask for enforcement records
A records request can ask for violation logs, hearing outcomes, fine schedules, and architectural approvals for the same category of issue. That information often reveals whether the association has been consistent.
Use calm wording
A strong selective-enforcement letter says: I dispute the notice, comparable properties appear to have the same condition, please provide enforcement records, and please pause fines until the board reviews this at a hearing.
