HOAs can fine homeowners, but that power isn't unlimited. Fines generally have to follow a published schedule, respect notice-and-hearing procedures, and in some states stay under statutory caps.

Fines usually require a published schedule

Many states require the association to adopt and distribute a schedule of penalties before it can fine you. A fine with no basis in an adopted schedule can be challenged.

Notice and a hearing usually come first

Before a fine takes effect, homeowners are often entitled to written notice and an opportunity for a hearing. If those steps were skipped, the fine may not be enforceable as issued.

Escalating fines and caps

Per-day or per-week escalating fines must typically follow the same schedule and, in some states, a statutory cap. If the amount looks arbitrary, ask the association to show its basis.
